CALL TO ORDER

 

THE MEETING WAS CALLED TO ORDER AT THE HOUR OF 7:00 P.M. BY MAYOR LOUDEN.  MAYOR LOUDEN OFFERED AN INVOCATION, FOLLOWED WITH THE PLEDGE OF ALLEGIANCE.

 

APPROVAL OF MINUTES: REGULAR MEETING ON FEBRUARY 11, 2008

 

THE MOTION WAS MADE BY COUNCILMAN GORDON AND SECONDED BY COUNCILMAN CRAIG AND DULY CARRIED TO ACCEPT THE MINUTES AS PRESENTED.

DISCUSSION: RENTAL PROPERTY ORDINANCE REVISION

 

MAYOR LOUDEN CALLED ATTENTION TO THE REVISIONS MADE TO THE PROPOSED RENTAL PROPERTY ORDINANCE.

 

COUNCILMAN CRAIG VOICED A CONCERN ON USING THE KENTUCKY BUILDING CODE TO INSPECT THESE RENTAL PROPERTIES.  HE FELT THE KENTUCKY BUILDING CODE WOULD BE TOO STRINGENT AND NONE OF THE PROPERTIES COULD BE BROUGHT TO THOSE STANDARDS.

 

ATTORNEY NICHOLAS MARSH ADVISED COUNCIL THE INSPECTIONS MUST BE DONE BY A STANDARD APPROVED BY THE COUNCIL, AND IT MUST BE INCLUDED IN THE ORDINANCE IN ORDER TO AVOID LIABILITY.

 

DEAN MILLER, SR. WHO WAS IN ATTENDANCE, ASKED WHY THE COUNCIL WAS MAKING A NEW ORDINANCE WHEN KENTUCKY ALREADY HAS THE SAME LAWS ON THE BOOKS. 

 

MAYOR LOUDEN ADVISED MR. MILLER THE LAWS ARE ONLY IF THERE IS A COMPLAINT BUT THE ORDINANCE WILL ALLOW FOR INSPECTIONS WITHOUT A COMPLAINT.

 

MR. MILLER SAID HE WOULD GO ALONG WITH THE INSPECTIONS BUT WAS AGAINST THE BUSINESS LICENSE FEE.  HE SAID THE FEE WOULD FORCE HIM TO PASS IT ON TO THE RENTERS WHO ARE STRUGGLING NOW TO PAY THE RENT.

 

MAYOR LOUDEN TOLD MR. MILLER THE FEE COLLECTED ON THE BUSINESS LICENSES WOULD TOTAL APPROXIMATELY $35,000 WHICH WOULD HELP TO COVER THE COST OF BRINGING SOMEONE ELSE IN TO HELP WITH THE INSPECTIONS.

 

JOHN WELCH, BUILDING INSPECTOR, SAID HE WAS MAKING A CHECKLIST

TO BE USED IN THE INSPECTIONS TO BE APPROVED BY COUNCIL.  MR. WELCH WENT ON TO SAY HE WOULD MAINLY BE USING COMMON SENSE TO CHECK THE SAFETY OF THE RENTAL PROPERTY.

 

COUNCILMAN DEAN MILLER JR. ASKED MR. WELCH WHAT EXACTLY HE WOULD BE USING TO CREATE THE CHECK LIST.  MR. WELCH SAID MAINLY THE CARROLLTON CODE, ALONG WITH COMMON SENSE.

 

ATTORNEY NICHOLAS MARSH AGAIN CAUTIONED COUNCIL, STATING THERE MUST BE A STANDARD AND IT MUST BE INCLUDED IN THE ORDINANCE TO REDUCE LIABILITY.  MR. MARSH SAID COMMON SENSE CAN NOT BE USED. IT MUST BE AN APPROVED CHECK LIST OR THE KENTUCKY BUILDING CODE THAT SETS THE STANDARDS OF INSPECTION.

 

DISCUSSION: REVISION OF CITY BUSINESS LICENSE ORDINANCE

 

MAYOR LOUDEN CALLED ATTENTION TO THE PROPOSED REVISION OF THE BUSINESS LICENSE ORDINANCE WHICH WOULD NOW INCLUDE A RENTAL PROPERTY LICENSE.

 

AFTER DISCUSSION, THE COUNCIL WAS IN AGREEMENT WITH THE PROPOSED REVISION.

 

DISCUSSION: ALLEY BEHIND HOMES ON PORT WILLIAM LANE

 

MAYOR LOUDEN REPORTED THAT CITY ATTORNEY, NICK MARSH, HAD DONE SOME RESEARCH AND FOUND THERE IS AN ALLEY BETWEEN THE BACK OF PORT WILLIAM LANE PROPERTIES AND A PIECE OF PROPERTY OWNED BY DENNIS AND KATHY GOFF.  IT IS SHOWN ON THE PLATT OF THE SUBDIVISION BUT HAS NEVER BE MAINTAINED BY THE CITY.

 

AFTER DISCUSSION, THE COUNCIL WANTED TIME TO LOOK AT THE PROPERTY AND MAKE THE DECISION ON WHETHER TO LEAVE IT AS IS OR TO CLOSE THE ALLEY AND LET THE PROPERTY BE DIVIDED BETWEEN ALL THE PROPERTY OWNERS INVOLVED.  THE COUNCIL WAS IN AGREEMENT ALL LEGAL FEES WOULD BE PAID BY THE PROPERTY OWNERS.

 

RESIGNATION: PLANNING AND ZONING COMMISSION

 

MAYOR LOUDEN ADVISED COUNCIL HE HAD RECEIVED TWO RESIGNATIONS FROM THE PLANNING AND ZONING COMMISSION. ONE WAS FROM RICHARD KATES, WHO ONLY GAVE A VERBAL RESIGNATION, AND THE OTHER WAS FROM JEFF FREMIN, WHO E-MAILED A RESIGNATION.

 

THE MOTION WAS MADE BY COUNCILMAN GORDON AND SECONDED BY COUNCILMAN WILHOITE AND DULY CARRIED TO ACCEPT THE RESIGNATIONS OF RICHARD KATES AND JEFF FREMIN FROM THE PLANNING AND ZONING COMMISSION.

PUBLIC HEARING

 

MAYOR LOUDEN ASKED IF COUNCIL WANTED A MODERATOR FOR THE PROPOSED RENTAL PROPERTY ORDINANCE PUBLIC HEARING ON MARCH 4, 2008 AT 7 P.M. AT WHEELER HALL OF JUSTICE.

 

THE COUNCIL WAS IN AGREEMENT TO HAVE A MODERATOR.

 

 

 

EXECUTIVE SESSION: LAND ACQUISITION

 

THE MOTION WAS MADE BY COUNCILWOMAN BROCK AND SECONDED BY COUNCILMAN MILLER AND DULY CARRIED TO ENTER INTO EXECUTIVE SESSION AT THE HOUR OF 7:59 P.M.

THE MOTION WAS MADE BY COUNCILMAN GORDON AND SECONDED BY COUNCILWOMAN GROBMYER AND DULY CARRIED TO COME OUT OF EXECUTIVE SESSION AT THE HOUR OF 8:17 P.M.
